Pennsylvania’s Nutrient Trading Program: Legal Issues and Challenges

At the request of the EPA Chesapeake Bay Program’s Scientific and Technical Advisory
Committee (STAC), the National Sea Grant Law Center investigated the legal issues that
may emerge as Pennsylvania begins to implement its policy. Most of the legal hurdles arise
from the Clean Water Act (CWA), but other federal and state statutes are implicated as
well. After laying out the regulatory framework for managing water pollution in the
Chesapeake Bay and Pennsylvania’s new trading policy, a number of potentially
problematic legal issues are discussed.
